Limited Warranty and Anti-Theft Lock Program Terms
FOR BLACKBURN 8" U-Lock; 8" U-Lock with 4' x 8mm Cable; 9" U-Lock; 10" U-Lock; 12" U-Lock with 4' x 12mm Cable BICYCLE LOCKS (“Locks”)
Warranty Coverage
Blackburn warrants its Locks to be free from defects in workmanship and materials for a period of one (1) year from the date of purchase. This warranty is extended only to the original consumer purchaser. During the warranty period, we will (at our sole option) repair, replace or refund the purchase price of any defective part or product covered by this warranty when it is returned by the original owner with proof of purchase and an assigned Return Goods Authorization number from the factory. The repair, replacement or refund will be without charge except for reasonable shipping, handling and insurance charges. Warranty Exclusions & Limitations
This warranty does not cover products damaged or rendered defective due to accident, misuse, abuse, modification, intentional or criminal act (except as provided in the Anti-Theft Program), neglect, reloading, improper handling, use or storage, or failure to follow instructions for use.
Blackburn Locks are intended to discourage and deter theft, but no bicycle lock can prevent all instances of theft. Accordingly, except as expressly provided in the Anti-Theft Program described below, REPAIR OR REPLACEMENT AS PROVIDED HEREIN IS YOUR EXCLUSIVE REMEDY FOR ANY DEFECTIVE PRODUCT. IN NO EVENT SHALL WE BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND ARISING OUT OF THE PURCHASE OR USE OF THIS PRODUCT, WHETHER BASED UPON CONTRACT, TORT, STATUTE OR OTHERWISE, INCLUDING WITHOUT LIMITATION THE VALUE OF LOST, DAMAGED OR STOLEN PROPERTY. In addition, ANY WARRANTIES IMPLIED BY LAW SHALL IN NO EVENT EXTEND BEYOND DURATION OF THIS EXPRESS WARRANTY. Some states do not allow the exclusion or limitation of incidental or consequential damages, or limitations on how long an implied warranty lasts, so the above limitations or exclusions may not apply to you. This warranty gives you specific legal rights, and you may also have other rights which vary from State to State.
Anti-Theft Program Eligibility
Except where prohibited by law, the Blackburn Anti-Theft Program (“Program”) is open to residents of the United States, other than New York, Canada, and the United Kingdom. Only the original Lock owner is eligible for the Program; registration or eligibility is not transferrable. The Program only applies to non-motorized/non-electric bicycles and scooters, and no more than two bicycles may be registered per Lock (“Qualifying Bicycle”). To be eligible for the Program, you must register your Lock and Qualifying Bicycle(s) within 15 days of purchase by completing the registration form located at data.blackburndesign.com/register (“Register”). You must include a copy of the receipt for the purchase of both the lock and bicycle.
The Anti-Theft Program coverage expires 1 year from the date of Registration, provided that the Registered Lock owner may elect to extend coverage for an additional two years for a cost of $10 or three years for a cost of $15 by calling Customer Support: 1-800-456-2355 Mon–Fri (9 a.m. – 6 p.m. EST). The Program is not to be construed as bicycle insurance.
Anti-Theft Program Coverage
The Program applies to a bona fide theft of a Registered bicycle meeting the following criteria:
- The Registered bicycle was locked with the associated Registered Lock at the time of the theft;
- The Registered owner followed all applicable instructions associated with the Registered Lock;
- The theft was accomplished by cutting, breaking or defeating the Registered Lock without use of the key or code; and
- The theft must be reported to the police and any applicable insurance carrier within 72 hours of the theft (“Qualifying Theft”).
Within 30 days of the Qualifying Theft, the Registered owner must report the incident by mailing to Blackburn the broken Lock, at least one key to the Lock, the police report of the Qualifying Theft and information on insurance coverage for the Qualifying Bicycle (“Report”). Upon receipt of a proper Report of a Qualifying Theft, the Registered owner is eligible for reimbursement as follows:
- Up to $500 for Security Level 4 locks (8" U-Lock; 8" U-Lock with 4' x 8mm Cable)
- Up to $1,000 for Security Level 5 Locks (9" U-Lock; 10" U-Lock; 12" U-Lock with 4' x 12mm Cable)
Reimbursement for a Qualifying Theft will be made up to the fair market value of the Registered bicycle(s), less any insurance recoveries for the loss, but in no event exceed the reimbursement levels listed above.
